In order to validate a patent in Portugal a translation of the patent into Portuguese must be furnished to the Portuguese Patent Office within 3 months of its issue in the EPO bulletin. Once the patent is granted it will be valid for 20 years from the filing date. Portuguese patents filed on or before May 31, 1995 will expire either 15 years from their granting date, or 20 years from their application date, whichever time period is longer. The back taxes calculation has been deleted from the country rules for Portugal. A new industrial property code, designed to bring Portugal into full conformity with EU and international norms, came into effect at the beginning of 2001.
