Patents in Italy
Once a patent is granted in Italy it covers all Italian territory (approximately 57 million inhabitants) as well as the State of San Marino and may be recognised by the Vatican City . Only attorneys-at-law or qualified patent agents (members of the Italian Industrial Property Consultants Institute) can file a patent. Patents must be filed in Italian. Applications are accepted at the Provincial Offices of the Ministry of Industry or at the Italian Patent and Trademark Office. It takes approximately 3 years to validate a patent and it is then valid for 20 years from the filing date.
The patentability of biotech inventions is still not regulated, because Italy has not yet implemented EU directive 98/44 EC of 6 July 1998. Regardless, biotech inventions are patentable within the limits of the Italian patent law (RD 22.6.1939, number 1127).
